Incisive Investments

Falling behind on your mortgage is stressful, and it's more common than people think. The most important thing is to act early. You have the most options at the start of the process, and fewer near the end.

How foreclosure works in Florida

Florida foreclosures go through the court, so the lender has to file a lawsuit before it can take the house. In plain terms:

  1. Missed payments. The lender sends late notices and a notice of default.
  2. The lawsuit is filed. A notice called a lis pendens is recorded with the county, telling the public the house is tied up in a court case.
  3. You get served. You have a short window to respond to the court. Don't ignore these papers.
  4. Judgment and sale date. If the lender wins, the judge sets a date for the house to be sold by the county clerk.

You can still sell the house, or pay off the loan, up until the clerk files the certificate of sale after the auction (or a later date if the judgment says so). Selling well before the sale date is almost always the better option.

Your options

  • Call your lender. Ask about a repayment plan, forbearance, or a loan modification. Get every promise in writing.
  • Get free help. HUD-approved housing counselors can go over your options at no cost. See Resources.
  • Talk to a lawyer. A foreclosure defense attorney can explain your rights and deadlines.
  • List the house. If you have time and equity, a listing may put more in your pocket. As a broker, I can do that.
  • Sell for cash. If time is short or the house needs work, a cash sale can close fast, pay off the loan, and keep a foreclosure off your record.

What I did
Bought it and renovated it

The seller was behind on payments and reached out after getting one of my letters. I bought the house with cash and we closed in 30 days. It needed a complete rehab: new roof and new everything except the water heater and AC. The renovation took about a month and a half.

How I can help

I'm a licensed Florida real estate broker who buys houses directly. I'll go over both paths with you, a listing or a cash sale, and tell you honestly which one makes more sense for your timeline. There's no cost and no pressure to talk.

I'm not a lawyer and this isn't legal advice. If you've been served with foreclosure papers, speak with an attorney about your deadlines.
